In December of 2009, Cody Lynn Brown, a 15 year old high school student, was killed when he and his friend attempted to run across the tracks at a train crossing in Lucas County, Ohio. Brown and his friend were struck by an Amtrak train. Brown’s father, Jeffrey Brown, has now filed a lawsuit, as the administrator of the estate for his son, against Amtrak (National Railroad Passenger Corporation) and the unknown operator of the locomotive.

The father filed a lawsuit in the Lucas County Court of Common Pleas in Toledo, Ohio, alleging wrongful death and negligence. Part of Mr. Brown’s lawsuit claims that Amtrak failed in properly instructing its employees as well as failing to make and enforce reasonable policies for the safety of people near the railroad tracks. Importantly, the incident is alleged to have occurred less than four-tenths of a mile away from the decedent’s high school.
