Under a federal law known as the Federal Railroad Safety Act, railroad workers are protected from any type of retaliatory action after they engage in certain protected activities. Courts have held that filing a FELA complaint for injuries can be a protected activity. This deters railroad employers from retaliating against employees simply for filing a complaint under the FELA.
